LGBT Activists Call for Removal of Anti-Gay Human Rights Commissioner

Virginia Beach is rapidly gaining national and international media attention due to the horrific anti-gay and anti-transgender remarks made by  a member of the City's Human Rights Commission. For a city that depends so heavily on tourism dollars, being perceived as intolerant and unwelcoming can be a kiss of death and Commissioner LaKendrick El toxic Facebook Posts are rapidly undue years of city efforts to enhance the city's image nationally and internationally. In an unusual display of unity, area LGBT organizations and activists have unanimously called for El's removal - something that seemingly is supported by a majority of the members of Virginia Beach City Council.  The Virginian Pilot is  reporting on the controversy that is generating animosity among elements of the city's population.  So far, there is no word on whether El will resign or be removed by City Council.  Here are article highlights (note El's comments about "special rights" - something that it is actually Christofascists and other right wing religious extremists are seeking for themselves):
Leaders in Hampton Roads’ LGBT community called for the removal of a member of Virginia Beach’s Human Rights Commission on Thursday following comments he posted on Facebook saying homosexuality was an “abomination” and that transgender people suffer from a mental illness.
It’s unclear what sparked the series of Facebook posts by LaKendrick El on Monday. El did not respond to a message from The Virginian-Pilot seeking comment.
El’s posts are not publicly viewable, but screen shots provided to the Pilot by the advocacy group Hampton Roads Pride show that he shared a 2017 news story about a transgender woman in Wyoming who was convicted of sexually assaulting a 10-year-old girl in a bathroom in a private home [El may have quoted a false Fox News story about this occurence].
“This is why we need to stop giving men in dresses passes,” El wrote. “I have daughters and I won’t accept them sharing a restroom with a grown man suffering from this mental illness.”
In a separate post less than 15 minutes later, El suggested that gay and lesbian people are getting special treatment, although he did not specify in what way.
“Stop promoting sexuality to our children. Two men or women together is an abomination according to my faith,” he wrote. “Stop promoting your sexual behavior expecting special treatment based on who you’re having sex with.”
LGBT advocates expressed dismay that a member of a human rights commission would express such views. Stacie Walls-Beegle, executive director of the LGBT Life Center in Norfolk, said El’s comments are especially harmful to those struggling to understand their sexuality.
El’s comments also drew the ire of his fellow commission members, the city’s mayor and a majority of city council members.
“The Virginia Beach Human Rights Commission was founded to institute, conduct and engage in educational and informational programs for the promotion of mutual understanding and respect among citizens and the fulfillment of human rights," Mayor Bobby Dyer said at a news conference.
“We believe the public comments of Brother LaKendrick Coburn El are contrary to these basic goals that are the core of the Human Rights Commission, and it is no longer appropriate for him to serve in this capacity."
The commission’s chairwoman, Sylvia Nery-Strickland, said El’s comments do not reflect her group’s position.
“I am deeply saddened at the anguish and pain affecting LGBT community,” she said. “I understand how hurtful these comments are. … These comments stand in start contrast to the public position of the Human Rights Commission."
I would also note that time and time again when political figures and right wing religious figures are stridently anti-gay, it's usually only a matter of time before they are exposed for being sexual predators or engaging in the type of sex they are outwardly condemning. Think former congressman Ed Shrock, Tim Haggard, and an endless parade of Republican office holders this blog has noted over the years.

Trump Regime Asks SCOTUS To Legalize Firing People For Being Transgender

Just when one thinks the Trump/Pence regime cannot get any more hostile to the rights - indeed the very existence of - LGBT Americans, another shoe drops and it becomes clear that until gays, lesbians and the transgender in particular disappear from public view, the relentless attacks will only intensify.  Pence is hysterically anti-gay in the typical mold of a likely self-loathing closeted gay.  What Trump actually believes is unclear since his main quest is to thrill Christofascists and maintain his support among anti-modernity, knuckle dragging evangelicals. While evangelicals remain rabidly anti-gay, it is transgender individuals who most garner their open hatred, in my view, because they most challenge evangelicals 12th century views on sex and sexuality.  Therefore, they must be destroyed or at least driven from public view.  Playing to this animus, yesterday, the Trump/Pence regime filed a brief with the U. S. Supreme Court that argues that transgender individuals have zero non-discrimination protections.  A piece in BuzzFeed looks at the filing.  Here are highlights:
The Trump administration on Friday took one of its most aggressive steps yet to legalize anti-transgender discrimination by telling the Supreme Court that federal law allows firing workers solely for being transgender, arguing a Michigan funeral home could fire a transgender woman because she wanted to wear women’s clothing on the job.
Although the administration was expected to take the stance — and had previously said firing workers on the basis of gender identity is legal under federal law — the latest court filing asks the nation’s top court to establish federal case law in a potentially sweeping setback for LGBTQ rights nationwide.
The case is a dispute over the word “sex.” Title VII of the Civil Rights Act of 1964 bans workplace discrimination because of sex, but the court’s justices have never decided what, precisely, the term means for LGBTQ workers.
The Justice Department’s brief on Friday contends the word refers to a person’s “biological sex” and, further, that transgender discrimination isn’t addressed by a 1989 Supreme Court ruling that found Title VII bans sex stereotyping.
“Title VII does not prohibit discrimination against transgender persons based on their transgender status,” says a filing by the Justice Department . . . Rather, the administration contends, “Title VII prohibits treating an individual less favorably than similarly situated individuals of the opposite sex.”
A Supreme Court ruling in favor of the administration’s position could set off cascading ramifications for LGBTQ Americans by asserting that laws banning sex-based discrimination must be construed narrowly, and it would have no application for sexual orientation or gender identity — a decision that would likely overflow far beyond workplaces.
No federal law explicitly bans anti-LGBTQ discrimination, but the term “sex” appears in countless state and federal laws, and various policies, that ban discrimination. They have often been used by courts and agencies to protect LGBTQ people in a range of settings — from jobs and schools to doctor’s offices — and a Supreme Court ruling that finds sex absolutely does not protect LGBTQ people could unravel previous court rulings and narrow the meaning of policies.
The administration’s argument against LGBTQ rights matches the advocacy of conservative Christian groups, which claim Congress only intended to ban discrimination because someone is male or female . . . .
The counterargument from LGBTQ advocates and several lower courts, however, is that the intent of lawmakers does not limit a law’s reach, but rather its meaning is defined by the statute’s plain text. They say anti-transgender discrimination can result from a person defying traditional sex stereotypes or because the person transitioned from one sex to another — and thus, it is inherently a type of sex discrimination.
The case at issue is one of three currently before the court about the rights of LGBTQ workers under Title VII — and the only one concerning a transgender worker.
Aimee Stephens had presented as a man when she started her job in 2007 at R.G. & G.R. Harris Funeral Homes in Michigan. Six years later, after Stephens announced plans to transition to a woman, the owner, Thomas Rost, fired her.
In siding with Stephens last year, a 49-page opinion led by Judge Karen Nelson Moore at the Court of Appeals for the 6th Circuit found that “The unrefuted facts show that the Funeral Home fired Stephens because she refused to abide by her employer’s stereotypical conception of her sex.”
But the Justice Department counters that when the Civil Rights Act passed in 1964, “the ordinary public meaning of ‘sex’ was biological sex. . . . In Stephens’ case, this means government lawyers now say it was legal to fire her — thereby holding the opposite position as the EEOC even though it is representing the EEOC. As such, it says the 6th Circuit ruling should also be reversed.
Represented by the Christian conservative group Alliance Defending Freedom, the funeral home filed a separate brief, filed Friday, that portrays the case as a fight over the essence of gender norms in society, playing off fears stoked by conservatives about transgender people preying on women in bathrooms.
There are ZERO cases of transgender people preying on women.  The same cannot be said for numerous Republican office holders or countless pastors and priests. Sadly, the ADF brief is yet another case of "conservative Christians" lying through their teeth and putting their hypocrisy on open display. If their lips are moving, the safest assumption is that they are lying.  Yes, I am passionate about this issue having been forced from a law firm years ago for being gay.

Trump/Pence Panel Launches New Attack on LGBT Rights

As noted before on this blog, the only group that has consistently seen its agenda pushed by the Trump/Pence regime are the the Christofascists.  Trump/Pence has been relentless in its effort to roll back LGBT and women's rights to the delight of those who want a Christian theocracy and the to inflict their toxic form of Christianity on all Americans. The latest move is the establishment of a panel on international human rights and “natural law,” that seems aimed at narrowing protections for women and members of the LGBT community.  Christofascists and far right Catholics have long used "natural law" to argue against LGBT rights and to push for patriarchal control of families and the subjugation of women - the Catholic Church's "natural law" has not evolved since the 12th century - so it is doubtful the panel will be embracing modern knowledge and concepts of equality.  Politico looks at this disturbing development:
The new body, to be called the Commission on Unalienable Rights, will advise Secretary of State Mike Pompeo, according to a notice the State Department quietly published Thursday on the Federal Register.
“The Commission will provide fresh thinking about human rights discourse where such discourse has departed from our nation's founding principles of natural law and natural rights,” states the notice, which is dated May 22.
Several human rights activists said Thursday that they were surprised by the move and trying to learn details. Some privately said they worry that talk of the “nation’s founding principles” and “natural law” are coded signals of plans to focus less on protecting women and LGBT people.
The word “natural” in such context is often interpreted to mean “God-given,” a phrasing that is less common in modern human rights literature but which could signal a religious component, experts said.
Activists and former U.S. officials noted that the Trump administration’s record on human rights so far is spotty at best.
The State Department already has an entire bureau devoted to the issues of human rights, democracy and labor, and it was not clear whether officials in that bureau were involved or even aware of the plans for the new commission.
The top State Department contact listed on the notice was Kiron Skinner, Pompeo's director of policy planning. . . . . Skinner drew criticism recently for seeming to suggest that China, a rising power, is such a fundamentally different culture from the United States that arguments about human rights may not have much effect in dialogue with Beijing.
Former top U.S. officials who dealt with rights issues expressed puzzlement over the commission’s creation.
“On the one hand it’s commendable that the secretary wants to place more emphasis on these issues, given that the administration to date has not been very outspoken on them,” said David Kramer, who served as the assistant secretary of State for human rights under the administration of Republican President George W. Bush. “On the other hand, I’m not sure what this commission is supposed to do that the human rights bureau doesn’t already do.”
Generally speaking, President Donald Trump and his aides have de-emphasized the role of human rights in their foreign policy, raising the issue only selectively — typically to raise pressure on countries considered adversaries.
The Republican administration has, for instance, highlighted the plight of female activists seeking more freedom in Iran, a longtime U.S. nemesis, but largely ignored similar challenges facing such activists in Saudi Arabia, a longtime U.S. ally.
The administration has made promoting religious freedom overseas a high priority, a move that has delighted Trump’s many evangelical Christian supporters.
But the administration also has rolled back domestic regulations aimed at protecting members of the LGBT community, especially those who are transgender.
It also has cut down sections about women’s reproductive rights in the State Department’s annual human rights report and made attempts to eliminate references to “sexual and reproductive health” in U.N. documents.
It is not clear who will serve on the panel or when their appointments will take effect, but activists and former U.S. officials noted that its composition will greatly affect the policies it promotes.
If some of the who's who of Christofascists who have Trump's ear end up on this panel, it will be a sign that the panel will have a sinister agenda. As for Skinner, she is a former Fox News contributor, which does little to instill any shred of confidence.

SCOTUS Leaves Transgender Student Rights in Place

Yesterday, anti-transgender Christofascists lost a round at the U.S. Supreme Court when the Court refused to hear a challenge from students - no doubt pushed by their parents - who claimed that a school system's bathroom policy allowing transgender students to use restrooms appropriate for the gender identity violated the privacy rights of the anti-trans students.  The rejected challenge is part of a larger Christofascist effort - which is being aided by the Trump/Pence regime - to reverse rights that transgender (and gays) have achieved under the Obama administration. A piece in Bloomberg Law looks at the Court's action.  Here are excerpts:

The U.S. Supreme Court won’t take up the controversy over bathroom use by transgender students. The justices turned away a challenge by four students from Boyertown Area High School in Pennsylvania who claim a school policy of allowing LGBT students to use their preferred bathroom violates their right to privacy.
Controversies have erupted nationwide as school districts decide whether to let LGBT students use bathrooms corresponding to their gender identity rather than their gender at birth.
Some challengers say it’s a violation of federal anti-discrimination laws not to accommodate LGBT students.  The Supreme Court was preparing to hear a similar case at the end of the Obama administration when a policy change by the Trump administration undid much of the lawsuit. The justices nixed the case.
The case is Doe v. Boyertown Area School Dist., U.S., No. 18-658, review denied 5/28/19.

Sadly, the Christofascists continue to believe that their rights override everyone elses and Trump is only too happy to play to this self-centered crowd.

Bigotry Lives on at Chesapeake's Deep Creek Academy

Since Donald Trump's election, white supremacists have felt emboldened.  So to have right wing Christians who feel themselves free to discriminate against their hate-filled Bronze Age beliefs thanks the Trump/Pence regime's open warfare against the rights of LGBT citizens as well as other minorities.  Here in Hampton Roads the most reactionary and anti-gay city is the city of Chesapeake, Virginia.  Thus, it is not surprising that anti-LGBT hatred is alive and well at Deep Creek Academy which is affiliated with Deep Creek Baptist Church, where those who do not subscribe to carefully cherry picked bible passages have been advised that they and their children are not welcome. After all, what's more "Christian" than bigotry against children - just ask Trump supporters who looked the other way at the horrific family separation policy which is still continuing although off the media's current radar.  Personally, I do not know why anyone would want to be a Baptist much less send their child to a Baptist affiliated school, especially many of such "academies" trace back to the racist "Massive Resistance" movement.  Hate is something that is learned and taught and that's what is happening at Deep Creek Academy.  Outwire757 looks at the anti-LGBT policies of this less than Christian academy.  Here are excerpts:
For over three years, the Denny family has been welcomed by the teachers and staff of Chesapeake’s Deep Creek Academy’s preschool. The school offered them a convenient, high quality, and affordable facility where their child could learn and grow with friends from their neighborhood.
That all came to an end last week when they were informed of a new policy that they feel targets their family.
Kelsea Denny (who transitioned from male to female this past year) received a re-enrollment letter from the Deep Creek Baptist Church, which houses and runs the preschool. She was alarmed by language in the letter that included a “Statement of Faith and Practice” and a new enrollment agreement policy. The letter included homophobic and transphobic views on same-sex marriage and gender expression that all parents of enrollees must sign as part of the application process.
The new language included includes the following:
“We are welcoming to all people and we affirm the Biblical and traditional definition of marriage being of one man to one woman and a Biblical and traditional understanding of gender identity.
“Deep Creek Academy (DCA) is a Christian school, and a ministry of Deep Creek Baptist Church (DCBC). Our teachers, students, and families are expected to conduct themselves in a manner in accordance with the faith statement and Christian values of DCA, DCBC, and its leadership. We reserve the right to refuse admission of an applicant or to discontinue enrollment of a student.”
The Director of the school forewarned the family that an updated policy was under discussion. According to Ms. Denny, the director of the school advocated against the policy and ultimately resigned her position in protest. The new policy still came as a surprise to Ms. Denny since school teachers and leadership had been open and supportive during her transition.
As Denny understands it, the new policy will not be implemented until the start of the next school term that begins in August 2019. Currently, her child is a student at DCA. However under the new policy, Ms. Denny would not be allowed to either drop off or pick up her child since that requires her to enter the building and sign the child in and out, in effect banning her from the school’s campus.
As a result, they are currently looking for another preschool in the area and are unsure how DCA will enforce this new policy dictated by leadership of DCBC.
DCA’s policy is similar to Immanuel Christian School in northern Virginia where Karen Pence, wife of Vice President Mike Pence teaches art twice a week.
OutWire757 has reached out to DCA and DCBC for comment. As of this writing, they have not responded.
Decent, moral people who support Christ's message should avoid Deep Creek Baptist Church and its pre-school that is teaching hatred against others.

Mike Pence Is Not a "Decent Guy"

Joe Biden has a knack for making verbal gaffes.  Last week he made a major gaffe when he called Mike Pence a "decent guy."  Pence is anything but a "decent guy" and has a long track record of viscous homophobia that has cost lives and fueled bigotry and hatred. Being familiar with Pence's record, better descriptions of him might include, cold, cruel, hypocrite, dangerous or, as actress/activist Cynthia Nixon noted, insidious.   In an op-ed Nixon demonstrates why Pence is not a "decent guy" and, in my view, should be shunned by truly decent people.  Anyone who cares about LGBT family members or friends or who supports freedom of religion for all, not just Christofascists, should view Pence with horror. Many conjecture that Pence and his long time allies among anti-gay hate groups may in fact be behind much of the Trump/Pence regime's war on LGBT rights.  Here are op-ed excerpts:

Speaking at a forum in Omaha on Thursday, Joe Biden called Vice President Pence “a decent guy.”
When a chorus of progressives and LGBTQ activists, including myself, pointed out that a man who has built his career on homophobia and misogyny cannot possibly be considered “decent,” some dismissed it as just outrage Twitter. While Biden later walked back his comments and acknowledged that “there is nothing decent about being anti-LGBTQ rights,” I think it’s important to explain why calling Pence “a decent guy” is an affront to the real meaning of the word.
While I like and admire much about Biden personally and politically, especially his championing of the Violence Against Women Act, when he talks about Pence being “a decent guy,” he is putting politeness over policy. In effect, he is saying that Pence’s record doesn’t matter. So let’s talk about that record. As governor of Indiana, Pence signed a “religious freedom” bill that would have allowed LGBTQ discrimination. He refused to lift a ban on needle exchange programs until a preventable HIV outbreak reached epidemic levels. On the website for his 2000 congressional campaign, Pence suggested support for so-called conversion therapy, which is associated with higher suicide risk for LGBTQ youth. During Pence’s tenure as head of the Indiana Policy Review Foundation, it ran an article that suggested that women should have to be married to obtain birth control. He published an article urging businesses not to hire gay people, and his congressional website said that "homosexuality is incompatible with military service.”
Pence played a leading role in the Trump administration’s efforts to ban transgender people from military service, and he serves in an administration that seeks to define transgender Americans out of existence by stripping federal recognition of their gender identity. This is a man whose abhorrence of queer people is so notorious that even President Trump reportedly once joked that Pence “wants to hang them all.” (The White House later denied it.)
Pence has also made it his mission to take down Planned Parenthood, leading the GOP’s war on one of the nation’s largest providers of reproductive and transgender health care.
These are not the actions of a decent man. The fact that Pence does vile, hateful things while well-coiffed and calm doesn’t make him decent; it makes him insidious and dangerous.
It’s easy to say nice things about Pence when you’re not personally threatened by his agenda. If Biden were being directly attacked in the same way that our community is, I think he would see Pence from a very different vantage point.
When politicians of a certain age reminisce about the “civility” that used to define Washington, it’s telling that the old guard conveniently forgets that this decorum has never been extended to all.
[T]he problem isn’t getting along with Republicans. The problem is legitimizing an agenda of hateful discrimination. It’s about the fear that someone who would give Pence the benefit of the doubt in the name of civility might also be willing to bargain away our rights in the name of bipartisanship.
There is a sense among genteel Washington that partisanship is rude and boorish. But when you’re fighting for the rights of marginalized communities who are under attack, it’s okay to stop being polite. This is not a time for hollow civility. This is a time to fight.
If Democrats are too wedded to the collegiality of the Senate dining room to call out the Republicans who espouse homophobia, how are we ever going to stop them?

It’s Dangerous to Forget about Mike Pence

With all the focus on Donald Trump and the FBI's launch of an investigation  of his possible role as an agent of Russia and his efforts to hide communications with Russia, including interpreter notes from one on one meetings with Vladimir Putin, it is easy to lose sight of the fact that a removal of Trump from office could potentially hand the White House to Mike Pence, provided, of course, Pence is not swept up into the effort to collude with Russia.  As noted a number of times before on this blog, Pence is about as extreme as one can get and has an ugly history of embracing discrimination, particularly anti-LGBT discrimination.  Moreover, like Rick Santorum and Ken Cuccinelli (who are a  little too hysterically anti-gay), Pence has all of the hallmarks of an extreme self-loathing closeted gay who believes attacks on the LGBT community are his best camouflage for his hidden "secret." His wife, Karen Pence, a/k/a mother per Pence himself, is not much better given her current work with a school that bans gay employees.  Thus, removing Trump who is demonstratively unfit for office could place someone equally unhinged in but a different way in a position to do great harm.  A piece in The Progressive looks at Trump's ugly history. Here are excerpts:
Since his Inauguration, Trump’s merry-go-round administration has been a consistent source of horror and amusement, most recently illustrated in Michaels Wolff’s expose, Fire and Fury. In the midst of the chaotic palace intrigue, one man seems to remain above the fray: Vice President Michael Richard Pence.

But it’s a bad idea to lose track of Mike Pence, particularly if you care about gay, lesbian, trans, and queer rights. In many ways, the Vice President has made attacking LGBTQ+ rights the cornerstone of his political career. And a look at his past crusades against this community leaves little room for doubt that he will continue that mission.
As Vice President, he has made six tie breaking votes in Senate, more than Vice Presidents Al Gore and Joe Biden combined. He cast the final vote scrapping federal rules to protect consumers from predatory financial organizations, what Senator Elizabeth Warren called a “giant wet kiss to Wall Street.”
It was Pence’s vote that confirmed Trump nominee Betsy DeVos as Secretary of Education and kickstarted a debate on Obamacare repeal. Most controversial, perhaps, was Pence’s approval of a bill to allow states to withhold federal funds for Planned Parenthood and other organizations providing reproductive healthcare, a longtime goal of Pence and his rightwing evangelical Christian allies.
Predictably, Pence used religious justification to push his agenda. “The day Obamacare passed was also a day of disappointment for the sanctity of life, but hope is finally shining through,” Pence said. “When this bill passes, it will be one of the defining victories for life.” According to a March 2017 poll, 75 percent of Americans, Republicans as well as Democrats, support the federal government’s continued funding of Planned Parenthood.
From early in his career, Pence has expressed outlier views. . . . . In an op-ed in 2000, Pence denied the correlation between smoking cigarettes and mortality. . . . . In similar fashion, Pence has denied global warming, citing “growing skepticism among scientists” about climate change and saying CO2 from fossil fuels can’t increase temperatures because it “is a naturally occurring phenomenon in nature.” He has also dismissed climate change as “an issue for the left."
But it is toward the gay community that Pence has expressed his most extreme views, so much so that Donald Trump once joked that Pence “wants to hang them all.”
In 2006, as head of the Republican Study Committee, a group of the most-conservative House members, he defended marriage as between a man and a woman and argued that any change to that threatens the stability of society.
In 2010, he opposed the repeal of “Don’t Ask, Don’t Tell,” which barred military service people from openly identifying as gay, claiming the military was no place for “social experimentation.” The website for his 2000 congressional campaign asserted that funding for HIV prevention “should be directed toward those institutions which provide assistance to those seeking to change their sexual behavior.”
Pence gained infamy that same year for a pushing a bill to jail same-sex couples who applied for marriage licenses.
The passing of the Religious Freedom Restoration Act was met with outrage by companies, celebrities, and thousands of Indiana residents. Angie’s List cancelled its $40 million expansion in Indianapolis, a move that would have brought a thousand new jobs to Indiana. New York, Washington, Connecticut, and Vermont all banned state-funded travel to Indiana. . . . Even the Republican mayor of Indianapolis, Greg Ballard, called on the legislature to repeal the bill, saying it “sends the wrong signal.”
Following the backlash, Pence signed a revised amendment to the bill, barring businesses from discriminating based on gender identity or sexual orientation. However, statewide laws concerning discrimination outside the workplace remained unchanged.
Pence’s dogged championing of “religious freedom” at the expense of civil rights for LGTBQ+ people poses equally dangerous threats for groups already very vulnerable to prejudice and violence.
In twenty-eight states, LGBTQ+ people don’t have anti-discrimination laws that protect them in the workplace, housing, and public accommodations.
And Pence remains dedicated to rolling back civil rights protections for LGBTQ+ people. He was behind the implementation of a transgender ban in the military, an effort subsequently blocked by federal judges. He also championed the transgender bathroom ban in public schools, a policy Trump later adopted.
A survey by the Human Rights Campaign released in January 2017 showed that 36 percent of transgender youth reported being personally bullied or harassed, and 56 percent had changed their self-expression or future plans since the election.  Just recently, on December 28, Kerrice Lewis, a lesbian woman of colour, was shot and burnt alive in the trunk of a car in Washington, D.C.
In pushing “religious freedom” at the explicit expense of this community’s safety and well-being, Mike Pence reveals the depth of his dangerous bias. A country that allows discrimination on the basis of race, sexual orientation, or gender identity is not a country with equal rights.

Major Companies Warn Trump/Pence To Leave Transgender Rights Alone

One of the few areas where the Trump/Pence regime has kept its campaign promises is in (i) appointing anti-gay judges (and Supreme Court justices) to the federal courts and (ii) working to role back LGBT non-discrimination protections.  These actions have kept promises made to a who's who of Christofascist leaders in June, 2016.  Nowhere has Trump/Pence been more relentless than in attacks against transgender citizen, with a recent proposal to define them out of existence under federal law.   Thankfully, numerous corporations are not remaining silent and have warned the toxic regime to stop attacking transgender rights. As LGBTQ Nation reports 56 corporations have warned Trump/Pence to cease its attacks.  Here are article highlights:

Dozens of major companies have warned the Trump administration to stop attacking transgender people. 56 corporations joined the statement to “oppose any administrative and legislative efforts to erase transgender protections.”
“Treating all people fairly, equally and with respect is the very core of IBM’s values. We believe no one should be discriminated against for being who they are,” Tia Silas, Global Chief Diversity & Inclusion Officer for IBM said in an emailed statement.
Collectively, the companies employ nearly 4.8 million people and generate more than $2.4 trillion in annual revenue.
Read the open letter below.
We, the undersigned businesses, stand with the millions of people in America who identify as transgender, gender non-binary, or intersex, and call for all such people to be treated with the respect and dignity everyone deserves.
We oppose any administrative and legislative efforts to erase transgender protections through reinterpretation of existing laws and regulations. We also fundamentally oppose any policy or regulation that violates the privacy rights of those that identify as transgender, gender non-binary, or intersex.
In the last two decades, dozens of federal courts have affirmed the rights and identities of transgender people. Cognizant of growing medical and scientific consensus, courts have recognized that policies that force people into a binary gender definition determined by birth anatomy fail to reflect the complex realities of gender identity and human biology.
Recognizing that diversity and inclusion are good for business, and that discrimination imposes enormous productivity costs (and exerts undue burdens), hundreds of companies, including the undersigned, have continued to expand inclusion for transgender people across corporate America. Currently more than 80 percent of the Fortune 500 have clear gender identity protections; two-thirds have transgender-inclusive healthcare coverage; hundreds have LGBTQ+ and Allies business resource groups and internal training efforts.
Transgender people are our beloved family members and friends, and our valued team members. What harms transgender people harms our companies.
We call for respect and transparency in policy-making, and for equality under the law for transgender people.

Goucester County School Board Continues War Against Transgender Students

Gloucester County School Board - a study in bigotry and cowardice.
Ironically, in the same issue of the Washington Post that has the piece cited in the prior post about the failure of evangelicals to police their own houses of worship, another story reports on how the Gloucester County, Virginia, school board - pressured no doubt by the same evangelical crowd who started the witch hunt in the first place - has opted to continue its war against transgender students.  Rather than do the right thing and abide by the recent federal court ruling that ordered the school board to protect the rights of transgender students, the board has filed an appeal to the Fourth Circuit Court of Appeals which, with luck, will render a legal form of bitch slapping to the board. Meanwhile, Gloucester County continues to enjoy a worldwide image of a bigoted backwater that ought to be avoided by progressive businesses and truly moral people.  Here are article highlights:
The Virginia school board that was sued by a transgender student over its bathroom rules said Friday it is appealing a federal judge’s decision.
Gavin Grimm, now 19, sued the Gloucester County School Board when he was a high school sophomore. Grimm, who is transgender, said the school board’s policy barring him from using the boys’ bathroom was discriminatory.
Late last month, a federal judge ruled in his favor, saying that the board’s policy violated Title IX, which bars sex discrimination in public schools, and the Equal Protection Clause, which assures parity under the law.
In a brief filed Friday, the board’s attorney, David P. Corrigan, challenged the ruling. Corrigan argued that Title IX does not protect the right of transgender students to use bathrooms that align with their gender identity. He said the board’s policy, which requires students to use bathrooms according to their “biological sex,” is constitutional.
Grimm had the backing of the Obama administration, which filed briefs in his favor and argued the bathroom rule violated Title IX. The U.S. Court of Appeals for the 4th Circuit, based in Richmond, sided with Grimm in 2016, deferring to the Obama administration’s interpretation of Title IX.
Grimm’s case was appealed to the Supreme Court by the school board, and the court was set to hear it in spring 2017. But the Supreme Court sent Grimm’s case back to a lower federal court after the Trump administration reversed the guidance on transgender student rights.
Grimm’s attorney, Joshua Block of the ACLU, welcomed Friday’s appeal by the school district. Grimm is now a 19-year-old activist in Berkeley, Calif.
“The vast majority of courts have already made clear that these discriminatory and harmful policies violate Title IX,” Block said. “We’re confident that the 4th Circuit would agree.”
Gloucester County remains a place to be avoided.

Did Gillespie Lie to the Northern Virginia Chamber?

GOP gubernatorial candidate Ed Gillespie, a/k/a Enron Ed, seemingly will say anything to win endorsements even if it involves lying.  Desperate to secure the endorsement of the Northern Virginia Chamber, Gillespie privately promised to veto any anti-transgender bathroom that might come to him if he is elected governor next month.  That promise, of course, is directly opposite of the promise Gillespie has made to the Christofascists who weld huge influence within the GOP base in Virginia, best embodied by The Family Foundation ("TFF"), a virulently anti-gay, anti-transgender which vigorously opposes any legal protections for LGBT Virginians and which, if given its way, would bring back the sodomy laws struck down in 2003 by the Supreme Court ruling in Lawrence v. Texas.  It is most disturbing that the leadership of the Northern Virginia Chamber fell for Gillespie's lie - or was all they cared about Gillespie's promised tax cuts that would most favor large corporations and the wealthy?  Don't be surprised when Gillespie breaks his promise after TFF president Victoria Cobb takes him to the woodshed tomorrow, if not sooner. The Washington Post looks at how Gillespie duped the Northern Virginia Chamber:
Republican Ed Gillespie won the endorsement of an influential Northern Virginia business group after privately assuring members that he would oppose any bills dictating which bathrooms transgender people must use — a new promise that shocked conservative backers.
The gubernatorial candidate “vowed to oppose bills like North Carolina’s HB2 that would threaten Virginia’s reputation as an open and welcoming Commonwealth,” Jim Corcoran, president of the Northern Virginia Chamber, said in a written statement announcing the endorsement by its political action arm, NOVABIZPAC.
In an interview Friday, Corcoran said Gillespie promised to oppose similar legislation two weeks ago, during a private interview with the 25-member board. He said that position factored into the board’s decision to back Gillespie over his Democratic rival, Lt. Gov. Ralph Northam, who has long supported LGBT rights. Corcoran said Gillespie made the vow after the board expressed concerns about HB2.
“We stated that we are an open and welcoming state here, we don’t want anything that is going to persuade persons that this is not a conducive place to do business,” Corcoran said.
But when the General Assembly considered a bathroom bill in January, Gillespie did not come out clearly for or against it. Rather, his campaign issued a statement that seemed aimed at having it both ways — echoing concerns raised by the bill’s advocates and taking a swipe at an Obama administration restroom directive, while also suggesting the matter should be left up to localities. Gillespie used stronger language — with no nod to local control that could be construed as opposition to state bathroom bills — at a Republican gathering in Amherst in April. This isn’t about bathrooms alone,” he [Gillespie] said, repeating warnings about co-ed showers and hotel stays. “And the fact is, we have to make clear, that we are going to protect our children from that. We are not going to allow for that to happen.”
If those statements were meant to convey Gillespie’s opposition to bathroom bills, that was lost on Don Blake, president of the Virginia Christian Alliance. He was surprised and upset to learn that Gillespie was promising to oppose that sort of legislation.
“It’s a very dangerous thing to speak out on positions that offend your base,” said Blake, who said he worked hard on Gillespie’s unsuccessful U.S. Senate bid in 2014.
“I’ve spent . . . a lot of time with him, talking about his Catholic faith, and he believes in the same things I believe in. He’s pro-life and pro-marriage,” he said. “To make a statement like that to get an endorsement from a business group will disappoint a lot of people. . . . It weakens your support. It doesn’t mean the base won’t go vote for him, but they may not put up yard signs and make phone calls.”
The PAC also endorsed state Sen. Jill Holtzman Vogel (R-Fauquier) over former federal prosecutor Justin Fairfax (D) in the race for lieutenant governor. And it backed Attorney General Mark R. Herring (D), who is running for reelection, over Republican challenger John Adams. . . .

Given Gillespie's career as a lobbyist, often lobbying on behalf of crooked corporations and unsavory types, it should come as no surprise that he'd be only too happy to lie to the Northern Virginia Chamber .  Anyone who believes Gillespie's promise is a fool.   Look at the anti-LGBT policies of Der Trumpenführer if you want to know what Gillespie really stands for.

Trump Judicial Nominee Calls Transgender Individuals "Satan's Plan"

Trump's anti-gay extremist judicial nominee
The canons of judicial conduct which apply to federal court judges require that judges avoid the appearance of impropriety and that they recuse themselves from any case where their personal beliefs prevent them from being unbiased.  This is the case also under most state canons of judicial conduct. Even Virginia's canons of judicial conduct (not that they are always properly enforced) provide that a judge cannot allow his views on homosexuality and gender identity to influence his ability to render an unbiased ruling in a case or to allow opposing counsel the be disrespectful or biased against an LGBT party to a case before the court.  Despite these established rules and norms, two of Donald Trump's recent judicial nominees would seemingly willing flout these restrictions on judicial conduct. Perhaps the worst is Jeff Mateer, Donald Trump’s nominee for the U.S. District Court for the Eastern District of Texas, who has voiced extremely anti-LGBT animus.  Metro Weekly looks at this frightening nominee who is yet another cog in Trump's promises to Christofascists to roll back LGBT rights and to make our lives a living hell.  Here are excerpts:
Jeff Mateer, Donald Trump’s nominee for the U.S. District Court for the Eastern District of Texas, once described transgender children as part of “Satan’s plan.”
In a pair of 2015 speeches, Mateer, the first assistant attorney general of Texas, bemoaned the trend of states banning conversion therapy for LGBTQ minors, denounced transgender rights, and alleged that allowing same-sex marriage would lead to efforts to legitimize polygamy and bestiality, reports CNN.
In a May 2015 speech titled “The Church and Homosexuality,” Mateer discussed a lawsuit in Colorado where parents of a transgender first-grader sued her school to allow their daughter to use the girls’ bathroom.
“Now I submit to you, a parent of three children who are now young adults, a first grader really knows what their sexual identity?” Mateer said. “I mean it just really shows you how Satan’s plan is working and the destruction that’s going on.”
Mateer previously served as general counsel of the First Liberty Institute, a conservative advocacy group that has been involved in pushing anti-LGBTQ initiatives or opposing expansions of LGBTQ rights, such as passage of a nondiscrimination ordinance in Plano, Texas.
In November 2015, Mateer was speaking at a conference hosted by controversial anti-LGBTQ pastor Kevin Swanson [who has advocated for the execution of gays], during which he took issue with attempts to ban conversion therapy in New Jersey and California.
Unsurprisingly, Mateer, who must be confirmed by the U.S. Senate, is facing criticism for his anti-gay statements.
“President Trump has once again demonstrated his complete disregard for the LGBT community by nominating a person to the U.S. District Court for the Eastern District of Texas who opposes LGBT rights and dignity,” David Dinielli, deputy legal director at the Southern Poverty Law Center, said in a statement. “The nominee’s past statements prove that he cannot and will not rule fairly on issues affecting the LGBT community.
“Jeff Mateer has demonized the most vulnerable members of our community and expressed support for conversion therapy — the dangerous, fraudulent, discredited and inhumane practice that purports to change a person’s sexual orientation or gender identity. There is no place on our federal bench for people who harbor this sort of extreme and dangerous bias.”
“It’s concerning that the Trump Administration is trying to infuse its anti-transgender ideology into our judicial system,” Jennifer Levi, transgender rights project director at GLBTQ Legal Advocates & Defenders, said in a statement. “Our courts must serve as a backstop to President Trump’s divisive and exclusionary policies, not promote discrimination. Courts must treat all Americans fairly and promote equal rights.”

Another of Trump's disturbing judicial nominees is AmyConey Barrett, a right wing Catholic law professor who once suggested that one’s religious beliefs ought to take precedence over the U.S. Constitution. As Huffington Post noted, the Alliance for Justice (a progressive judicial advocacy group) called on the Trump regime to withdraw Barrett’s nomination because of her past writings on the role of faith in the courtroom. The organization also objected to her views on the matter of stare decisis, or the doctrine of legal precedent.  Stated another way, Barrett would seemingly ignore standing case law precidents that do no conform to her religious views.

Trump: Pentagon Has Six Months to Create New Transgender Military Ban

Der  Trumpenführer mad many campaign promises.  To date he has delivered on very few of them.  There is one glaring exception to this do nothing situation: the assault on LGBT rights that was made to a who's who of American Christofascists in June, 2016, in New York City.  With the aid of extreme homophobes Jeff Sessions and Betsy De Vos, already protections of LGBT students are  under assault and LGBT protections put in place by the Obama administration have been rescinded. Now, following up on his anti-transgender tweets, Der  Trumpenführer  has issued a directive to the Pentagon giving it six months to formulate a new ban on transgender members of the U.S. military. The Los Angeles Blade has some details on the development (note two things: Mike Pence has been the driving force behind the ban and how the state of California may be positioning itself to oppose the ban).  Here are highlights:
White House guidance on the transgender military service ban President Trump ordered via tweet July 26 is headed to the Pentagon, as soon as Thursday afternoon or possibly Friday morning, a senior White House source told the Los Angeles Blade.
The Guidance has been boiled down to a 2½-page memo that directs Defense Sec. Mattis to come up with a policy in six months, stop spending money on transgender-related medical treatment for active duty trans servicemembers and gauges fitness for service based on “deployability”—whether the trans individual can ably serve in a war zone and engage in military exercises or function a ship for months, officials told the Wall Street Journal.
That guidance was also watered down from the complete ban Trump ordered to one that would allow active duty trans service members to continue serving after even Republicans opposed the policy change. The weakened policy requires that recruitment and the accessions policy be halted (they are now), enlistment contracts not be renewed, promotions result in discharges, and transgender-specific healthcare be prohibited.
At an Aug. 14 news conference, Mattis indicated support for trans service members, noting the United States Armed Forces is “a widely diverse force. We look at E Pluribus Unum on our coins. Out of many, one. They were simply emphasizing on the battlefield we are one team and that’s the way we stay.”
It has now been widely reported that Mattis quietly intervened to scotch efforts by anti-LGBT Reps. Duncan Hunter and Vicky Hartzler to get a version of the trans ban passed through Congress. Nor did he object when Marine Corps Gen. Joseph Dunford, Chairman of the Joint Chiefs, said the current policy of open service would remain in effect until it is formally replaced or when Navy Secretary Spencer said “any patriot” should be allowed to serve, echoing other commanders supporting their trans service members.
However, Mattis also noted that the military chain of command requires him to follow orders given by the civilian commander-in-chief.
The White House senior official source — who spoke to the Blade on condition of anonymity — said Vice President Mike Pence is the driving force behind the ban. In fact, he has been spearheading the trans ban reinstatement since last May, at the behest of conservative leaders such as Tony Perkins, head of the Family Research Council, and scores of retired anti-LGBT military officers.
Trump’s fear of his evangelical base is more powerful than his promises to the LGBT community, justifying the ban by saying: “It’s been a very difficult situation and I think I’m doing a lot of people a favor by coming out and just saying it. As you know, it’s been a very complicated issue for the military, it’s been a very confusing issue for the military, and I think I’m doing the military a great favor.”
Fact check: an estimated 6,000 trans service members have been serving openly without incident since the original ban was lifted by then-Defense Secretary Ash Carter in July 2016, after a year of study and deliberation.
News of the ban prompted the California Legislative LGBT Caucus to introduce a Resolution saying California would protect its own trans service members. California is home to more than 190,000 active and reserve service people on three army bases, seven marine bases, 10 navy bases, six air force bases and five reserve and numerous U.S. Coast Guard bases.[A]t the end of the resolution, the Caucus notes what could prove to be a wrinkle in Trump’s plan. “Resolved, That the Legislature of the State of California calls upon the Governor of California to direct the California National Guard, the California Air National Guard, and the other Armed Forces of the state to take no action that discriminates against transgender service members in enlistment, promotion, or any other aspect of their service, on the basis of their gender identity or expression, unless superseded by federal law, regulation, or formal directive from the United States Department of Defense.”
But what happens if and when transgender members of the state National Guard are called up and federalized? Low’s office says they are looking into that. AJR 22 will be heard on the Assembly floor in the coming weeks.
Every individual who voted for Trump/Pence or stayed home and failed to vote against Trump bears responsibility for this assault of the civil rights of other Americans.  These people will find no forgiveness from me.  They deliberately harmed my community and threaten my civil rights.

Trump's Transgender Ban Is Becoming Official Policy

Time and time again the only campaign promises Donald Trump is keeping are those made to Christofascists leaders in June, 2016, at a meeting at Trump Tower.  For background, on June 21, 2016, Donald Trump met with a who's who of far right Christian groups - a number of which are certified hate groups - in New York City.  The purpose?  To win the support of these Christian extremists who could then rally their followers to vote for the Trump/Pence ticket through their insidious, under the radar networks.  Among the rallying points promised to these extremists were the appointment of anti-abortion and anti-gay justices to the U.S. Supreme Court, repealing the six decade old Johnson Amendment so that churches could engage in political campaigns, anti-transgender bathroom bills, and license to discriminate laws disguised as efforts to protect the "religious freedom" of Christian extremists.  Trump delivered on the first promise when he placed Neil Gorsuch on the Court, his Justice Department and Department of Education are aggressively rolling back LGBT protections, and now Trump has targeted transgender members of the U.S. military.  As a piece in the Los Angeles Blade written by fellow LGBT blogger, Karen Ocamb, reports, Trump's anti-transgender tweets are becoming official policy. The issue will be whether or not the military leadership complies with Trump's openly discriminatory directives.  Here are article excerpts:
President Donald Trump may be on a 17- day vacation but his White House has been scrambling to hand him a “win” by the time he returns. Trump’s tweets last week announcing a ban on transgender individuals serving openly in the U.S. military was turned into a “guidance” policy for implementation that passed muster with the White House Counsel’s office Friday night. Approved by Trump, the new policy is expected to be now delivered into the hands of Defense Secretary Jim Mattis, who has been quiet on the issue with approximately 15,000 trans servicemembers under his command.
After his review, Mattis is expected to order a deliberate implementation by the Pentagon, which could take a period of time.
Though the policy—called “A Guidance Policy for Open Transgender Service Phase Out”—has not yet been made public, sources familiar with the planning said it would encourage early retirement, usher out any enlisted personnel after their contract is up, and would fire trans officers up for promotion. Basically, said a source, “the administration want to get rid of transgender servicemembers as fast as they can.”
No one yet knows what will happen to the servicemembers currently fighting in combat. The new policy does allow trans servicemembers to continue serving but apparently does not offer any protection from harassment or other efforts to get them to quit.
Trump said in his tweets that the decision to ban trans military service was made after consultation with his generals and to safeguard the readiness of the armed forces. That flies in the face of a Rand study  commissioned in 2016 by then-Sec. of Defense Ash Carter that said there were “few obstacles” to lifting the existing ban against trans service.
Trump focused his attention on the cost of medical care for trans servicemembers who want to transition on the job. But, the New York Times reported: “Paying for the procedures would cost the Pentagon between $2.9 million to $4.2 million a year, the report said. By comparison, the Pentagon each year spends $6 billion of its $610 billion budget on medical costs for active-duty service members.”
Last Tuesday, 56 retired generals and admirals came out against Trump’s proposed ban. “This proposed ban, if implemented, would cause significant disruptions, deprive the military of mission-critical talent, and compromise the integrity of transgender troops who would be forced to live a lie, as well as non-transgender peers who would be forced to choose between reporting their comrades or disobeying policy,” the retired officers said in a statement, The Hill reported. Two sources says they have confirmation from their sources at the White House and Pentagon that the “phase out” policy is on its way to the Secretary of Defense.
Matthew F. Thorn, Executive Director of OutServe-SLDN, released the following statement:
“The President’s order to remove transgender service members from the United States armed forces is nothing less than a purge. He is implementing this purge based on bigotry, motivated by agents of an ideology that has no concern for the national defense, and in blatant disregard of the experience of career officers who spent more than a year developing and implementing the current policy. . . . OutServe-SLDN with our partner Lambda Legal will be immediately filing a lawsuit in federal court to challenge this action.”
As Trump's approval numbers continue to fall it seems clear that he will do anything to appease the Christofascists - along with white supremacists - who put him in office.  My August VEER Magazine piece (which is on the streets around the 15th of the month) covers the intensifying attacks on LGBT Americans.
