Betsy DeVos Continues to Be An Enemy Of LGBT People

The anti-LGBT agenda of the Trump/Pence regime ranges from the petty - the White House posting of  a photo of all the NATO countries' leaders’ spouses  omitted the name of Luxembourg’s Gauthier Destenay, the husband of the only openly gay prime minister in the world, Xavier Bettel - to truly disturbing as embodied by Trump's reversal of Obama administration non-discrimination executive orders.  In the realm of public education things are particularly frightening with Betsy DeVos, a long time religious zealot from a family that has provided millions and millions of dollars to anti-LGBT hate group organizations such as Family Research Council (her mother is on the board of a major contributor to FRC) and continues to support conversion therapy.  Now, DeVos is making it clear that under the smoke screen of "states rights" federal funding will be available to schools that openly discriminate against LGBT students and children of LGBT parents.  DeVos has about as much empathy for members of the LGBT community as the Inquisition had for Jews and supposed heretics.  A piece in Huffington Post looks at the always toxic DeVos.  Here are excerpts (Note, she suggests that racial discrimination might be OK with her as well):
The video of Education Secretary Betsy DeVos confirming that she would allow private schools to receive federal dollars while they blatantly discriminate against gay, lesbian, bisexual and transgender students is simply stunning. Congresswoman Katherine M. Clark, a Democrat from Massachusetts, asked DeVos point blank in a hearing yesterday if she would allow federal funds to go to a school that bans LGBT students or students with gay or lesbian parents, and she used the Lighthouse Christian Academy in Indiana as an example.
DeVos, in an eerily calm manner, said that it would be up to the states to make the decision to allow “parents to make choices” when it comes to putting their kids in a hostile anti-LGBTQ environment, where lies and distortions that lead to bullying and violence are taught to children about queer people, while receiving federal money in the form of vouchers.
Even when Clark raised the issue of a school that might discriminate against African-Americans, DeVos, after mentioning something vague about civil rights protections being “broadly applicable,” still deferred to “parents making choices” as the most important principle. DeVos made it clear that it was up to the state to decide, and, as Clark pointed out, couldn’t give “one example,” in which a state’s discriminatory practice in education would be stood up to by the Department of Education in the form of withholding money.
This is the same Betsy DeVos who some media outlets told us just before her confirmation hearings had gone through some sort of transformation, or was always, in fact, supportive of LGBTQ rights and was simply misunderstood. It was an odd, convenient narrative coming at a time when she needed it.
As with Trump himself, just because Betsy DeVos might help out her well-off Republican gay friends ― who might return the favor by helping her in other ways ― doesn’t mean she’s not devoted to her family’s longtime goals, nor to putting religious beliefs before LGBTQ rights. While she gave McNalley and his husband a reference letter in their successful effort to adopt a child as gay parents, she also financially contributed to the campaign of GOP legislator Andrea LaFontaine ― a zealous religious conservative ― who spearheaded a draconian Michigan law passed in 2015, weeks before the Supreme Court’s landmark marriage equality ruling, that allows state-funded faith-based adoption agencies to turn away gay and lesbian couples based on their sexual orientation. That law seems right in line with DeVos’ statements yesterday, refusing to rule out giving federal money to schools that discriminate against LGBTQ students and parents.
DeVos has said in the past that she wanted public education to “advance God’s kingdom.”  . . . . she was listed as a vice president of her mother’s foundation, which is a major donor to anti-LGBTQ hate groups Focus on the Family and Family Research Council.
DeVos claimed during her confirmation hearings, “I fully embrace equality” and rejected “conversion therapy,” which is promoted by many of the groups to which her family donates.  But once in office, DeVos went right along with the Trump administration action of rescinding guidelines for the treatment of transgender students, put in place by the Obama administration.
And now we have her clear statements on allowing schools to get federal funds even if they discriminate against LGBTQ people ― or any group.
Whatever Betsy DeVos might or might not truly believe really doesn’t matter. It is her public statements, and her actions, that are the only important barometers. And so far, she’s proven to be an enemy of LGBTQ people.

Trump Taps Anti-LGBT Extremist to Head Department of Education

First we saw anti-black, anti-LBGT Jeff Sessions tapped by Donald Trump to be Attorney General of the United States.  Now, Trump  has tapped anti-LGBT extremist billionaire Betsy DeVos to head the Department of Education.  Not only is DeVos stridently anti-LGBT rights, but she is a rabid supporter of school choice and school vouchers, a system that would drain funding from public schools and help fund schools run by Christofascist denominations.   Indeed, DeVos would happily do away with public schools all together. For those unfamiliar with DeVos, she and her husband have contributed huge sums of money to anti-LGBT and anti-public school causes. Meanwhile, neither DeVos nor any of her children have ever darkened the door of a public school, yet she is now to head the Department of Education which focuses - at least historically - on public education.   A piece at Joe My God looks at the DeVos family's anti-gay, anti-public school history.  Here are article highlights:

Her family is one of NOM’s most massive contributors. TheDetroit News reports:

President-elect Donald Trump on Wednesday said he intends to appoint West Michigan GOP mega donor and philanthropist Betsy DeVos to be his education secretary, putting an ardent supporter of school choice in charge of the nation’s education policy.
DeVos, 58, is seen as a national leader in the school choice movement, which she has called an attempt to “empower” parents to find good schools for their children, whether they be traditional public schools in other neighborhoods, charter schools, virtual schools or private institutions.
DeVos is a former Michigan Republican Party chairwoman whose husband, Dick, unsuccessfully ran for governor in 2006. The DeVos family, heirs to the Amway Corp. fortune, are the most prolific donors to the Michigan Republican Party, GOP officeholders and candidates.
From a 2012 ABC News story:

The Douglas and Maria DeVos Foundation, financially supported by Amway president Doug DeVos, donated $500,000 to the National Organization for Marriage (NOM), an anti-gay marriage group that was one of the leading advocates against same-sex marriage initiatives in eight states. Because of that 2009 donation, gay rights activist are calling for a boycott of Ada, Mich.-based Amway, a health and beauty products company, and its affiliates including the Orlando Magic basketball team, which DeVos’ father and Amway co-founder Richard DeVos owns.

DeVos and her husband also donated $200,000 to Michigan’s ballot measure to ban same-sex marriage.

The Michigan billionaire is a troubling choice, given her extreme history of supporting anti-LGBT causes and opposing efforts to bring fairness and equality to LGBT Americans. Between 2010 and 2013, the DeVos family and their various foundations have given millions of dollars to anti-LGBT groups, including Focus on the Family, Family Research Council and the Alliance Defending Freedom.
Each of these organizations has fought vehemently against protecting LGBT students from discrimination and harassment. They have also lobbied for legislation to prohibit students from using the restroom that matches their gender identity; opposed rights for same sex parents; and are fighting to require education professionals – including teachers, counselors, therapists, administration and more – to out LGBT students to their parents, even if they are not ready.

An LGBT rights organization, Freedom for All Americans, had this to say about DeVos:

The Michigan billionaire is a troubling choice, given her extreme history of supporting anti-LGBT causes and opposing efforts to bring fairness and equality to LGBT Americans. Between 2010 and 2013, the DeVos family and their various foundations have given millions of dollars to anti-LGBT groups, including Focus on the Family, Family Research Council and the Alliance Defending Freedom.

By the way, each of the groups cited above is a certified hate group.

Religious Schools Seek Right to Discriminate Against LGBT Students

Even as the far right Christians are calling for a war against all of Islam, these home grown religious extremists are seeking to expand their war on gays on a new front.  They want the right to discriminate against LGBT students and to ignore Title IX of the Education Amendments of 1972 forbids sex discrimination at any educational institution that receives federal funding.  Stated another way, they want special rights and to place themselves above the law.  As I have said many times, no one is more selfish or self-centered that the self-anointed godly folk.  These folks make the Biblical Pharisees look like Mother Theresa in comparison.  Their effort needs to be defeated and I'd go a step farther: not only yank their federal funding, but take away their tax exempt status on all of the property and income except that directly related to their chapels and worship centers.  Everything else should be taxed (I'd do the same for all church property other than houses of worship themselves).  There is no reason that all citizens are being forced to indirectly underwrite their operations.  I'd even argue that to force the rest of us to do so violates the non-establishment clause of the First Amendment.  A piece in The Advocate looks at this effort for special rights while making the rest of us underwrite it financially through tax exempt status for the haters.  Here are highlights:

With the expansion of LGBT rights, there has been a spike in the number of religiously affiliated colleges and universities seeking exemptions from federal antidiscrimination laws.

Title IX of the Education Amendments of 1972 forbids sex discrimination at any educational institution that receives federal funding, which most do in some form, be it research grants or student financial aid. But it allows any school “controlled by a religious organization” to apply for a waiver from the nondiscrimination requirement if complying with Title IX “would not be consistent with the religious tenets of such organization.”

“These ‘right-to-discriminate’ waivers were relatively rare until the last year,” reports The Column, a Minnesota-based nonprofit LGBT news site, with “a handful” of schools seeking them to avoid putting women in leadership positions. But in 2014, the U.S. Department of Education held that Title IX’s ban on sex discrimination also banned discrimination against transgender and gender-nonconforming people, leading many more schools to apply for waivers. Also, the spread of marriage equality, now nationwide after June’s Supreme Court ruling, has conservative institutions worried they would be required to treat married same-sex couples the same as opposite-sex ones — in access to student housing, for instance.

The schools that have been granted the exemptions include Belmont Abbey College in North Carolina, Franciscan University of Steubenville in Ohio, Judson College in Alabama, East Texas Baptist University, Oklahoma Christian University, Spring Arbor University in Michigan, and Simpson University in California. Those with waivers pending include Biola University in California, Colorado Christian University, Ohio Christian University, and Multnomah University in Portland.

Some schools have sought the waivers so they could bar or expel transgender students, and some have targeted lesbian, gay, and bisexual students and staff as well, reports the site, which obtained the data through a Freedom of Information Act request. Many of them have used a sample policy by the Christian Legal Society.

“The trend of religiously affiliated, but publicly financed, colleges receiving exemptions from the U.S. Department of Education in order to discriminate against LGBTQ students and employees is disturbing,” attorney Paul Southwick, who has represented students in discrimination suits . . . . we are also seeing the protections of Title IX gutted at the very institutions where students need those protections the most.”

There is recourse, however, Southwick said. He suggested that students or staff who have experienced discrimination file an internal appeal, with the help of a lawyer if possible. “Additionally, students should file a Title IX complaint with the U.S. Department of Education’s Office of Civil Rights,” he said. “This is important and should always be done. Even if their college has a religious exemption from Title IX, the exemption may not apply or it may not stick after being challenged.”
Religion remains a great evil.

U.S. Department of Education: Title IX Protects LGBT Students

While many states give lips service to protecting LGBT public school children, in states like Virginia, true protections are nearly non-existent and time and time again we see teachers and administrators failing to act and/or looking the other way as LGBT students are bullied and/or subjected to discrimination.  Now, an announcement by the U.S. Department of Education ("DOE") may put new pressure on schools receiving federal funding to actually take action.  Specifically, the DOE's Office of Civil Rights has issued guidelines underscoring that Title IX of the Education Amendments of 1972 (“Title IX”) to the federal civil rights laws that prohibits discrimination on the basis of sex in federally funded education programs and activities applies to LGBT students and transgender students in particular.  The 53 page document can be found here.  Here are highlights from a statement by the National Center for Transgender Equality:

The guidance, from the Department's Office for Civil Rights (OCR), states: "Title IX's sex discrimination prohibition extends to claims of discrimination based on gender identity or failure to conform to stereotypical notions of masculinity or femininity and OCR accepts such complaints for investigation."

"This announcement is a breakthrough for transgender students, who too often face hostility at school and refusal by school officials to accept them for who they truly are," said NCTE Policy Director Harper Jean Tobin. "It is now clearer than ever that schools nationwide are responsible for ensuring that transgender students are respected and safe, and students can seek protection from the Department of Education and the courts if schools fail to do so."

...This historic statement on gender identity is embedded in a larger guidance document on the responsibilities of schools to prevent and respond to sexual violence against any student—part of a package of guidance and resources announced by the Obama Administration today to address this widespread problem. Also being launched is a new website, NotAlone.gov, collecting resources for students and schools and reporting settlements with schools related to sexual violence on campus. NCTE applauds the White House Task Force to Protect Students from Sexual Assault and the federal agencies involved in this effort.

"Sexual violence in schools is shockingly common in the U.S. and needs to stop," said NCTE Executive Director Mara Keisling. "That the Federal Government is addressing sexual violence is so important. And it is also important, and honestly a relief, that the Department of Education is clarifying Title IX in a way that will make schools safer for transgender students."
It goes without saying that the Christofascists will not be happy and will likely view this as another instance of their religious freedom - i.e., unrestricted license to persecute others - as being  under attack.
