Due to the snow storm that hit the Hampton Roads region of Virginia
overnight, tomorrow's hearing for oral arguments in Bostic v. Rainey,
the case pending in the U.S. District Court for the Eastern District of
Virginia that challenges Virginia's ban on same sex marriage is being
rescheduled according to the American Foundation for Equal Rights. Here is the press release from AFER:
One of the most severe snow storms in a decade has swept through the South, dumping almost 10 inches of snow in southeast Virginia and creating dangerous conditions for an area that rarely sees such inclement precipitation.
Because of the weather, the federal district court announced that it will be closed tomorrow. AFER attorneys Ted Olson and David Boies were scheduled to appear before the court to argue that the state’s ban on marriage for gay and lesbian couples is unconstitutional.
The Court will soon reschedule oral argument for a later date.
Frankly, I am not surprised. The roads in this area are a huge mess
and, if I go to my law office tomorrow, I will be driving our old Ford
Expedition with 4 wheel drive. Making matters worse, temperatures will
be in the teens tonight causing whatever thawing has occurred today to
refreeze.
